Indonesian Youtube Content Creators Can Legally Use Their Content as Loan Collateral

JAKARTADAILY.ID – The Minister of Law and Human Rights, Yasonna Laoly said that YouTube content can legally be used as collateral for bank and non-bank loans.

According to Yasonna, this is due to a provision that has been regulated in Government Regulation (PP) Number 24 of 2022 concerning the Creative Economy.

"This means that intellectual property certificates can be guaranteed at a fiduciary bank," Yasonna said, quoted from the Directorate General of Intellectual Property (DJKI) Youtube channel, Sunday, July 24, 2022.

Yasonna explained that the PP, among others, regulates financing schemes obtained by creative financial actors through intellectual property-based banks and non-bank financial institutions.

Yasonna gave an example, if an intellectual property such as a song or video copyright has a certificate that has been uploaded to Youtube and has many viewers, then the certificate can be used as a bank loan collateral.

"If we have created a song on YouTube, there are millions of viewers, the certificate already has a selling value, if we suddenly need money," he said.

"So, the higher the brand value and intellectual property, the bigger the loan value," he continued.

Yasonna added that Youtube content that can be guaranteed is that which comes from copyrights or brands that have been registered with the Directorate General of Intellectual Property.

Previously, during the "Yasonna Hearing" activity in Surakarta, Wednesday, July 20, 2022, Yasonna said the Ministry of Law and Human Rights had taken a number of steps to make it easier for IP protection in Indonesia. One of them is the digitization of IP services.

"The Ministry of Law and Human Rights is building a digital service system for recording copyright and registering trademarks, patents, and industrial designs online that can be accessed anytime and anywhere," said Yasonna at Pendhapi Gedhe Surakarta City Hall.

The latest innovation from the Ministry of Law and Human Rights is the Automatic Approval for Copyright Registration (POP HC). This service speeds up the copyright approval process in minutes.

Support from the Ministry of Law and Human Rights is also provided through the application of special tariffs for Micro and Small Enterprises (MSEs).

The non-software copyright registration fee for MSMEs is Rp 200,000, while Rp 300,000 for software copyrights.
