JAKARTADAILY.ID – Amid efforts by Erick Thohir to clean up 12 state-owned companies from alleged corruption, Bakhtiar Rosyidi, former Finance Director of PT Sigma Cipta Caraka subsidiary PT Telkom (Persero), is suing the SOE Minister in court, together with the Main Director of PT Telkom Tbk, Ririek Adriansyah.
Erick Thohir and Ririek Adriansyah as defendants in a case against the law with case number 160/Pdt.G/2023/PN jkt PST/9/3/2023 were registered at the Central Jakarta District Court on Thursday, March 9, 2023.
Heri Supriadi, Alex Janangkih Sinaga, Herry M Zen, PT Asiatel Globalindo, PT Linkadata Citra Mandiri, PT Telering Onix Pratama, PT Visiland Dharma Sarana, PT Wahana Ekonomi Semesta, and Joko Aswanto, are co-defendants, while PT Bursa Efek Indonesia is also co-defendant.
In the Central Jakarta District Court's SIPP, the date for the first trial was set for Friday, March 10, 2023. In the petitum, Bakhtiar Rosyidi asked the judge to accept and grant the plaintiff's (Bakhtiar Rosyidi) lawsuit in its entirety; Then, declared the actions of the defendants, including Erick Thohir, as unlawful.
The plaintiff ordered the defendants (Erick Thohir cs) to pay material and immaterial losses to the plaintiff (Bakhtiar Rosyidi) in the amount of IDR 21.5 billion. Then ordered the payment of dwangsom (penalty/fine) in the amount of IDR 100 million to the plaintiff even though there were appeals and cassation efforts.
In addition, the plaintiff, Bakhtiar Rosyidi, ordered the defendants to pay a late payment of Rp. 10 million per day since the decision has binding legal force, incrach van gewijsde.
Previously, the lawsuit for unlawful acts against Erick Thohir and Ririek Adriansyah, another Bakhtiar Rosyidi attorney, Kasman Sangaji, explained that the lawsuit was related to a report on an alleged fictitious project.
It began with financing or falsifying financial statements of IDR 1.7 trillion from an estimated project value of IDR 2.2 trillion in the 2017-2018 period.
Because of that, his party requested that this case be disclosed in a clear and loud manner.
"With this report, we ask the ranks of the legal apparatus to take firm legal action," said Kasman Sangaji.
He explained that carrying out law enforcement and prosecution of all responsible parties, including the leadership in charge of business whose activities were suspected of triggering state financial losses.
"We are asking for a re-audit of PT Telkom's finances," he said.
